Proxy Care: Allowing a Trusted Caregiver to Help with Health Maintenance
There is a meaningful gap between what a physician prescribes and what happens at home between appointments. For many families, the challenge isn’t just finding someone to help — it’s finding someone trusted, trained, and legally authorized to assist with the health maintenance tasks their loved one can no longer safely manage alone.
In Georgia, there is a specific solution designed for exactly this situation. It’s called Proxy Care. It’s what can help your loved one stay at home rather than move to a long-term care or skilled nursing facility.
What Is a Proxy Caregiver?
Under Georgia law (O.C.G.A. 43-26-12), a proxy caregiver is an unlicensed individual who is trained by a licensed healthcare professional to perform health maintenance activities for a person who cannot perform those activities themselves. This allows individuals and families to receive care from someone they already know and trust — including a home care caregiver — rather than requiring a licensed nurse for every health-related task at home.
Proxy caregiving was established by the Georgia General Assembly in 2010 specifically to give people — including older adults and individuals with disabilities — a practical pathway to receive assistance with medications and personal health care in a home or community-based setting.
What Can a Proxy Caregiver Do?
Health maintenance activities under the proxy care framework are defined as limited activities that — if not for a person’s condition or disability — they could reasonably be expected to do for themselves. These are basic, ongoing care functions with precise, predictable directions and reasonably predictable outcomes. They include things such as:
- Assistance with medications
- Managing personal hygiene routines
- Cleaning a feeding tube
- Other comparable basic health maintenance tasks
Proxy care does not include complex clinical care — such as administering intravenous medications or complex wound care — nor activities that require critical clinical judgment.
All proxy care activities must be carried out according to written orders from an attending physician, advance practice registered nurse, or physician assistant. A plan of care must be in place that specifies which activities may be performed, any specialized procedures, and the training and evaluation requirements for the proxy caregiver.
